Your access and use of the Site is subject to the terms and conditions of use described below (the "Terms of Use"). All pages within the Site and any information, material, or content made available on or through the Site, including without limitation Sport Reporting Messages, are subject to these Terms of Use (collectively, “Content”). Please read these Terms of Use carefully before using the Site. Your access to and use of the Site are conditioned on your acceptance of and compliance with these Terms of Use. These Terms of Use apply to all visitors, users and others who access or use the Site (“You”). By accessing or using the Site or by checking the box next to “I accept” when registering for an account or purchasing services from the Site, you agree to these Terms of Use.

  1. MODIFICATION OF THESE TERMS OF USE OR THE SITE

    MATC reserves the right to change or discontinue the Site or any portion of the Site, including all Content, at any time without notice to You. MATC reserves the right to change the Terms of Use under which the Site is offered, including but not limited to the charges associated with the use of the Service. All changes will be effective immediately upon their posting on this Site. If MATC makes a material change to these Terms of Use, MATC will endeavor to notify You of that change via email if your email address is on file, but it remains your responsibility to monitor these Terms of Use for changes. By accessing the Site after any changes to these Terms of Use, You agree to all such changes, regardless of whether You received email notice.
  2. YOUR USE OF THE SITE

    You are granted a limited, non-exclusive, revocable right to access and use this Site solely for your own personal use. This right does not include the right to and You shall not modify, reproduce, or resell any part of the Site’s Content; use any robot, spider, data miner, or other automated or semi-automated means to extract or gather data or Content from the Site; or otherwise use this Site or any of its Content in any manner other than the manner in which it is intended to be used, unless You first obtain MATC’s express written consent. You may not use this Site or its Content for any purpose prohibited or restricted by law. Except for the limited right expressly granted to You in these Terms of Use, Sports Reporting and its licensors expressly reserve all other rights and licenses.
  3. TERMINATION OF USE

    MATC may issue a warning, temporarily suspend, indefinitely suspend, or terminate your right to use or access all or any part of this Site, including any account hereon, without notice, for any reason or no reason in MATC’s sole discretion, including, without limitation, violation of these Terms of Use or MATC’s belief that your use or access would violate any applicable law or would be harmful to the interests of, or potentially cause financial loss or legal liability to, MATC, another user, or any third party.
  4. YOUR ACCOUNT

    Should you choose to sign up for an account with MATC or choose to sign up to receive or participate in any related services, you opt-in to receiving communications from MATC, and You will also be subject to any additional services terms to which You have agreed or which are otherwise posted on this Website, all of which are expressly made a part of these Terms of Use and your agreement with MATC. If you register for an account with MATC on this Site, You are responsible for maintaining the confidentiality of your username and password. You agree to accept full responsibility for all activities that take place under your username. You agree to immediately notify MATC if you suspect any breach of security related to this Site.
  5. YOU CONSENT TO RECEIVE SPORT REPORTING MESSAGES

    When You register for an account on the Site, You have the option to receive regular communications from MATC via email or SMS text message (“Sport Reporting Messages”). If You provide MATC with your telephone number, then you expressly consent to receive Sport Reporting Messages via SMS message. If at any time You wish to alter how or if You receive Sport Reporting Messages, You may do any of the following: (1) reply “STOP” to a MATC SMS text message, (2) unsubscribe via the link at the bottom of a MATC email, or (3) change Your account settings by logging into your account on the Site.

    Delivery of Sport Reporting Messages is made on a "best effort" bases. All content in Sport Reporting Messages is regarded as informational and not life saving in nature, and MATC makes no warranty, guarantee, or other representation regarding the accuracy of any information contained in a Sport Reporting Message. Deliveries of such Sport Reporting Messages might be subject to delay or failure. Your regular messaging and carrier service rates apply to the delivery of Sport Reporting Messages via SMS messages, and You are solely responsible for any fees, charges, and taxes associated with receiving any such messages from MATC, include without limitation, equipment, per-message, internet service provider, carrier, taxes and other similar fees or charges.
  6. PRIVACY

    By accessing and using this Site, you agree to the terms of the MATC Privacy Policy, which are incorporated into these Terms of Use by reference. You are also expressly agreeing and consenting to the collection and use of your personal information and other data as set forth in (and more fully described in) the MATC Privacy Policy.
  7. CHILDREN’S PRIVACY

    Individuals under the age of 13 are not permitted to use the Site or receive Sport Reporting Messages without the supervision of a parent or legal guardian. Furthermore, we do not knowingly allow children under the age of 13 to register for an online account or to post personal information on our Site. By signing up for an account on the Site, you acknowledge and agree that you are at least 13 years old.
  8. INDEMNIFICATION

    You agree to indemnify, defend, and hold harmless MATC, its owners, board members, officers, representatives, directors, employees, consultants, third party suppliers, licensors, and agents from any and all losses, expenses, claims, liabilities, damages, and costs (including, without limitation, attorneys’ fees) arising from or related to (a) your use of the Site; (b) your use of any Content or data downloaded or otherwise obtained from the Site; or (c) your violation of these Terms of Use or applicable law, including without limitation, your infringement of any intellectual property or other right of MATC or any other person or entity.
  9. DISCLAIMER OF WARRANTIES

    THE SITE, INCLUDING ANY CONTENT, UNDERLYING SOFTWARE, AND SERVICES PROVIDED THROUGH THE SITE, MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. MATC AND/OR ITS SUPPLIERS MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, AND ACCURACY OF THE SITE OR CONTENT CONTAINED ON THE SITE FOR ANY PURPOSE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ALL SUCH CONTENT ON THE SITE ARE PROVIDED "AS IS" WITHOUT WARRANTY OR CONDITION OF ANY KIND, EITHER EXPRESS OR IMPLIED. MATC AND/OR ITS SUPPLIERS HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH REGARD TO THE SITE AND CONTENT, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
  10. LIABILITY OF LIABILITY

    TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MATC AND/OR ITS SUPPLIERS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR THE LOSS OF USE OR REPLACEMENT OF DATA, OR LOST PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OF THE SITE, ANY OF ITS CONTENT, OR ANY MATC MESSAGES OR OTHER SERVICES OBTAINED ON OR THROUGH THE SITE, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF MATC OR ANY OF ITS SUPPLIERS HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY IN THE TERMS OF USE, TO THE EXTENT PERMISSIBLE BY LAW, MATC’S AGGREGATE LIABILITY TO YOU SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).

    SOME STATES/JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CERTAIN TYPES OF DAMAGES OR WARRANTIES. ACCORDINGLY, SOME OF THE EXCLUSIONS AND LIMITATIONS ABOVE MAY NOT APPLY.
  11. INTERPRETATION AND DISPUTES

    These Terms of Use are governed by the laws of the United States and the State of Wisconsin, without regard to any conflict of law provisions. Venue shall be exclusively in the state or federal courts located in Madison, Wisconsin with respect to any dispute arising under these Terms of Use. Any cause of action or claim with respect to the Site must be commenced within two (2) years after the action or claim arises or is discovered. If any part of these Terms of Use are determined to be invalid or unenforceable pursuant to applicable law, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the Terms of Use shall continue in effect.
  12. ENTIRE AGREEMENT

    Unless otherwise specified herein, these Terms of Use constitute the entire agreement between You and MATC with respect to the Site and supersede all prior or contemporaneous communications and proposals, whether electronic, oral or written, between You and MATC with respect to the Site. Any waiver of any provision of these Terms of Use will be effective only if in writing and signed by MATC. These Terms of Use will inure to the benefit of MATC’s successors and assigns.
  13. COPYRIGHT AND OTHER PROPRIETARY RIGHTS

    MATC, or third parties from whom MATC has permission, own the Site and all Content that is used on the Site. All proprietary Content on the Site including, without limitation, the Site's layout, organization, and design, and any graphics, text, icons, audio, video, and the like are protected by copyrights, trademarks, service marks, trade secrets, and other proprietary rights and laws. You agree to comply with all applicable laws by not copying or using this proprietary Content, except as allowed by these Terms of Use or by written consent of the owner of the proprietary rights.

    You grant MATC a perpetual, royalty-free, irrevocable, sub-licenseable, assignable, and transferable license to use, copy, distribute, display, modify, transfer, create derivative works of, or otherwise exploit any feedback, submissions, ideas (including requests or suggestions), concepts, know-how, or techniques that You submit to the Site or otherwise choose to share with MATC through other communication channels for any purpose (including without limitation commercialization) and without compensation to You.
  14. TRADEMARKS

    MATC, or third parties from whom MATC has permission, own the trademarks and service marks that are used on the Site. All rights are reserved by MATC and said third parties, and no implied rights are granted to you or any third parties. These and other graphics, logos, service marks, trademarks, and trade dress of MATC and its licensors may not be used without prior written consent of MATC or its licensor, as the case may be. Without limiting the foregoing, no MATC trademark or trade dress may be used in connection with any product or service not provided by MATC, in any manner that is likely to cause confusion among users, or in any manner that disparages or discredits MATC.
  15. DIGITAL MILLIUM COPYRIGHT ACT

    If You have reason to believe that material on the Site infringes your copyright, please send a notice by mail or email to the contact information listed below requesting that the infringing material be removed. The notice must contain the following information:
    1. A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright;
    2. A description of the work claimed to have been infringed, or a representative list of such works if the notice is intended to cover multiple works on the Site;
    3. Identification of the allegedly infringing material and where the material is located on the Site;
    4. Your contact information, including your name, address, telephone number, and email address;
    5. A statement that You have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
    6. A statement that the information in the notice is accurate and, under penalty of perjury, that You are authorized to act on behalf of the owner of the exclusive right that has allegedly been infringed.

    The Site may contain links to other unrelated websites on the Internet, including social media websites. MATC is not responsible for the content, accuracy, copyright compliance, decency standards, or other materials on such websites. These Terms of Use do not apply to such unrelated websites and You should review the privacy policy and terms of use for any website that You visit. MATC makes no representations or warranties regarding the security of any information you make available to such websites. MATC is not liable for any losses or damages incurred as the result of your business dealings with such third parties.
